If you want a hearing before the order of suspension or revocation takes effect, the request has to be made within 10 days of receipt of the notice, and the department holds the hearing before the effective date when the request is postmarked or received inside that span. Receipt is the trigger, so the date the officer handed the form over is the date to write down, photograph and keep. The statute also narrows the subject matter: the issues are the facts listed in section 13557, not guilt of a crime.
Section 13353.3 fixes the length. Where there is no qualifying prior inside ten years, no administrative refusal finding and no earlier excessive-alcohol determination, the privilege is suspended for four months. The order becomes effective 30 days after service of the notice. Those two figures do different work. The 30-day gap is the planning window; the four months is the consequence, and neither one waits for the criminal calendar at the Harbor Justice Center to reach a disposition.
The same section provides the exit. A four-month suspension terminates where the person is convicted of a violation arising out of the same occurrence, is eligible for a restricted license under section 13352 or 13352.1, installs a functioning certified ignition interlock device as those sections require, and satisfies the remaining conditions. Read that as a sequence rather than a favor. Eligibility, installation and compliance all have to be documented before the restriction is issued, and the paperwork travels between the court, the installer and the department.
This is the least understood consequence in a market built around boats. The administrative suspension in section 13353.2 is written around a person driving a motor vehicle at 0.08 percent or more, and the refusal machinery that costs a license sits in the Vehicle Code as well. On the water, Harbors and Navigation Code section 655.1 handles testing differently: the arrested person is advised of a right to refuse chemical testing and warned that an officer may seek a search warrant compelling a blood sample. The pressure point is a warrant, not the driving privilege. None of that makes a vessel charge minor, because section 668 still carries jail exposure and a boating conviction is a criminal conviction on the record.
Vehicle Code section 23538 splits first offenders by result. Below 0.20 percent the referral is at least three months in a licensed program of at least 30 hours of activities. At 0.20 percent or above, or after a refusal, it becomes at least nine months and at least 60 hours. The section also says the driving privilege is not restored until proof of successful completion reaches department headquarters, which means an unopened envelope or an unforwarded certificate can quietly extend the problem past the suspension itself.
Geography does real damage here. Balboa Peninsula is a long single-access strip, Balboa Island is served by a short ferry and one bridge, and Newport Coast and Corona del Mar sit above the highway on hillside streets with limited transit. Summer makes it worse: the city puts its permanent population at 86,738 and says the figure climbs past 100,000 with 20,000 to 100,000 visitors on a summer day. A restriction that permits travel to work and to the program is worth more in that traffic than a shortened suspension with no driving at all.
Keep the temporary permit, the order of suspension, the citation, the release conditions and any tow receipt together, with the dates on the front of the file. Add the name of the arresting agency, whether Harbor Patrol or the police department, since the record trail differs. Then note whether any test was breath, blood or refused, because that answer decides which statute governs the administrative side.
A criminal engagement cannot be priced off a result, because rule 1.5(c)(2) of the California Rules of Professional Conduct forbids a contingent fee for a defendant in a criminal case. Ask instead whether the described work includes the hearing request, a subpoena for the officer, a continuance and the later restriction application, or whether those are billed as separate steps.
